- 5. Types of Data, Purposes of Processing and Legal Basis for Processing
i) Personal Data processed
Technical information
▪ In-game character ID, server, gameplay activities and gameplay-related data (including access time, play time, participation history and chat
information), or data derived from or generated through your use of the Platform and the MSU Community, or otherwise made available in connection with the services provided therein, wallet address, and Digital Assets balances connected to the wallet address.

▪ Email address, mobile number, IP address, and other necessary personal information required for payment authentication

- 6. Refusal, Failure, Inability to Provide Necessary Personal Data
6.2 Synergy Apps are essential elements of the MSU Community (as defined in the Terms of Services), and some of the functionality of these Synergy Apps may rely on data accessible via our APIs. Through these APIs, developers may query data using in-game asset keys (such as wallet addresses and character IDs) to retrieve information including, but not limited to character information, item information, Digital Asset balances, metadata, NFT details, or Marketplace transaction data. Although such data may be publicly accessible via the blockchain, such availability constitutes inherent and necessary part of the MSU services and the operation of the MSU Community for the purpose of building Synergy Apps (which Synergy App may or may not be used by you). Some Synergy Apps may be used for commercial purposes, i.e., generate revenue through their operations or advertising, and the Company may collect fees in return for providing the infrastructure, tools, and resources necessary to support operation of the Synergy Apps. Accordingly, such availability forms part of the basis not only for participation in the MSU Community but also for enabling downstream services and commercial activities built upon it. Participation in the MSU Community inherently includes the functioning of Synergy Apps that rely on the relevant data, and such availability is required for the proper provision of MSU services. For the avoidance of doubt, certain data made available through such APIs or interfaces may also be accessible by other users of the Platform, and may be displayed, viewed, or utilized within the Platform or through Synergy Apps or related services.
- 10. Sharing of Personal Data with Third Parties
10.3.6. Sharing with Synergy App developers: In connection with the performance of our services, we may share your on-chain and off-chain game, gameplay activities and gameplay-related data or non-game data including but not limited to character information, in-game item information, Digital Assets balances, metadata and NFT details, Marketplace transaction data associated with the in-game asset keys (such as wallet addresses and character IDs). Data made available through the APIs may include on-chain data, metadata publicly disclosed on the blockchain, gameplay activities and gameplay-related data, as well as data derived from or generated through your use of the Platform and the MSU Community, or otherwise made available in connection with the services provided therein. For example, your in-game character information may be visible to other users of the Platform or the Synergy App or third party sites and services.
10.3.8. Blockchain Data: Certain information that you record or generate in connection with the use of our services is stored on public blockchains. Such information is inherently transparent, immutable, and outside the Company’s control, and may therefore be publicly accessible to third parties and cannot be modified or deleted by the Company. As a result, this information may be permanently publicly accessible to and may be viewed, processed, analyzed and used by third parties. The Company does not determine or control how data on public blockchains is processed, accessed, viewed, analyzed or used by third parties, and disclaims any responsibility or liability in this regard. You should carefully consider the information you choose to record on public blockchains, as such data will become part of a permanent public record that is beyond the Company’s ability to manage or remove.
- 14. Data Retention and Records
14.6. To enhance user experience and manage interactions among users, non-personal data and certain data that may be associated with users, including game and transaction data generated during your use of our services, may be shared with, processed, accessed, viewed, analyzed and used by other users via our Platform, Platform APIs or open APIs or other interfaces linked to our services.

- Introduce
The following persons are prohibited from using the MSU Community and/or any service or content in relation to the MSU Community (each, a “Prohibited User”): (i) persons who appear on the Office of Foreign Assets Control (OFAC) of the United States Department of the Treasury’s Specially Designated Nationals and Blocked Persons List (SDN), United States Department of Commerce’s Denied Persons List or other similar lists; (ii) persons who are nationals or residents of Cuba, Iran, North Korea, Syria, Crimea, Donetsk, Lugansk or any other country, territory, or jurisdiction that is embargoed by the United States, the United Arab Emirates, or other applicable governmental authorities; (iii) persons who are nationals or residents of jurisdictions designated as Restricted Regions under Exhibit A, solely to the extent that their access to or use of the MSU Community (or any part, feature, or functionality thereof) is restricted or prohibited pursuant to applicable laws, regulations, sanctions programs, or the Company’s compliance obligations and policies; (iv) persons, or their affiliates, whose accounts have been subject to termination for cause; (ivv) persons who are not individual natural persons, and (vi) a person who, directly or indirectly, uses, employs, operates or creates a computer program to simulate the human behavior of a User (“Bots”).
“Restricted Regions” as designated in Exhibit A refer to jurisdictions subject to enhanced compliance review and/or potential service restriction based on applicable laws, regulations, sanctions programs, regulatory guidance, governmental directives, and the Company’s compliance obligations and policies. In such jurisdictions, certain functionalities of the MSU Community, including Digital Asset-related features (such as conversion, minting, bridging, transfer, or other on-chain token-related activities) may be restricted, limited, or unavailable, as determined by the Company in its discretion. Access to other features or services of the MSU Community may remain available, subject to the foregoing legal and compliance requirements.
For the avoidance of doubt, designation of a jurisdiction as a Restricted Region shall not, in and of itself, automatically render all persons located therein Prohibited Users, unless such jurisdiction is subject to comprehensive sanctions or embargoes.
- II. THE PLATFORM AND THE MSU COMMUNITY
Notwithstanding any other provision of these Terms, certain features, functions, or Digital Assetrelated services (including without limitation conversion, minting, bridging, transfer, or other on-chain functionalities involving NXPC or other Digital Assets) may not be available in certain jurisdictions and may be restricted, suspended, modified, or disabled at any time in our sole discretion to comply with applicable laws, regulations, sanctions programs, or risk management policies. The availability of any Digital Asset, conversion mechanism (including without limitation NESO to NXPC conversion), crossnetwork transfer functionality, or bridging capability shall not be guaranteed in any jurisdiction. We reserve the right, without prior notice, to restrict, suspend, or permanently disable access to any such feature for Users located in, residing in, accessing from, or otherwise connected to jurisdictions where such services may be restricted under applicable laws or regulatory considerations.
- VII. GAME ITEMS, NXPC, NESO, NFT AND FT
A. Goods or Services. OFFCHAIN OR ONCHAIN DIGITAL ASSETS EXCHANGED FOR (x) OTHER DIGITAL ASSETS, AND (y) ANY PAYMENT INSTRUMENTS WITHIN THE MSU COMMUNITY, (I) ARE REGARDED AS GOODS OR SERVICES, AND ARE NOT CURRENCIES, PAYMENT MEANS OR PREPAID PAYMENT INSTRUMENTS, (II) ARE UTILITY TOKENS FOR USE SOLELY WITHIN THE MSU COMMUNITY, (III) DO NOT REPRESENT A SECURITY, VIRTUAL ASSET, OR FINANCIAL INSTRUMENT UNDER REGULATIONS OF THE FINANCIAL SERVICES REGULATORY AUTHORITY, AND (IV) NESO CANNOT BE WITHDRAWN EXTERNALLY OR CANNOT BE EXCHANGED FOR CURRENCIES. COMPANY DOES NOT FACILITATE ANY SECONDARY MARKET FOR NXPC and NESO. NOTWITHSTANDING THE FOREGOING, THE USE, CONVERSION, MINTING, BRIDGING, TRANSFER, OR OTHER FUNCTIONALITY RELATING TO NXPC, NESO, NFT, FT, OR ANY OTHER DIGITAL ASSET MAY BE SUBJECT TO GEOGRAPHIC, REGULATORY, OR COMPLIANCE-BASED RESTRICTIONS. SUCH RESTRICTIONS MAY APPLY SELECTIVELY TO SPECIFIC FUNCTIONALITIES AND MAY BE IMPLEMENTED WITHOUT PRIOR NOTICE.
- Exhibit A: List of Restricted Regions
The following regions are designated as jurisdictions subject to enhanced compliance review and potential service restrictions (each, a “Restricted Region”).
Users located in, residing in, accessing from, or otherwise connected to a Restricted Region may be subject to full or partial restrictions with respect to the MSU Community and/or any service or content in relation to or specific Digital Asset-related functionalities even if access to certain IP-based or gameplay services remains available.
The Company reserves the right, in its sole discretion and without prior notice, to determine the scope, duration, and extent of any restriction applicable to Users connected to a Restricted Region, based on the applicable laws, sanctions programs, regulatory interpretations, compliance obligations, or internal risk management considerations.
Restricted Regions include: Afghanistan, Algeria, Austria, Bangladesh, Belgium, Bulgaria, China, Croatia, Crimea, Cuba, Cyprus, Czech Republic, Denmark, Donetsk, Dominican Republic, Egypt, Estonia, Finland, France, Germany, Ghana, Greece, Hungary, Iran, Iraq, Ireland, Italy, Japan, Latvia, Lithuania, Luxembourg, Lugansk, Malta, Morocco, Netherlands, Nepal, North Korea, Oman, Pakistan, Poland, Portugal, Qatar, Romania, Russia, Slovakia, Slovenia, South Korea, Spain, Sweden, Syria, Tunisia, United Arab Emirates, Ukraine, United Kingdom, United States, Vietnam
Designation as a Restricted Region does not automatically mean complete inaccessibility of the MSU Community; however, no User in such jurisdiction shall have any right or expectation that any specific service or Digital Asset functionality will remain available. Availability of any service in a Restricted Region shall not be construed as a representation or warranty that such service is lawful in that jurisdiction. Additionally, services may be prohibited or withheld from regions not explicitly listed above based on legal requirements and other considerations.
You are solely responsible for compliance with applicable local laws and regulations and for any risks that may arise from using the services in these regions.
