[Updated] Operation Policy
The following key sections will be added or amended with this update to the Operation Policy.
[2-7] Users who wish to contest a Service restriction should contact the Support Center within 15 days of the restriction being applied. Where a separate violation of the Operation Policy is confirmed in the course of reviewing such a request, a separate restriction may be imposed in respect of that violation.
[3-1-3] The level of restriction imposed will depend on the nature and severity of the behavior. However, the Service Provider may adjust the level of restriction based on its reasonable consideration of the relevant circumstances, which may lead to changes in the type and duration of the restriction, including the application of a level of restriction different from that set out in the tables under Section [3-3]. The Service Provider may impose restrictions by reference to the category most similar to the conduct concerned and may apply a higher tier of restriction where the seriousness of the conduct so warrants.
[3-1-13] Using multiple Wallets or accounts to evade or circumvent restrictions, service limitations, or escalated measures for repeated violations under the Operation Policy is prohibited. If it is confirmed that a user has attempted to reset their restriction history or avoid the application of escalated measures including by transferring characters, items or in-game assets between Wallets or accounts, or by creating or replacing Wallets, the Service Provider may deem such conduct restriction evasion.
※ The consequences of restriction evasion, including aggregation of violation histories and carry-over of the cumulative violation tier, are set out under “Restriction Evasion via Multiple Wallets or Accounts” in Section [3-3-2].
[3-3-2] Abnormal Use of the Service
| Type | 1st | 2nd | 3rd | 4th |
| Restriction Evasion via Multiple Wallets or Accounts | Carry-over of the cumulative violation tier based on the combined violation histories of all related Wallets, accounts, and characters. | |||
[3-3-5] Abuse of Payment and Chargeback
The following are strictly prohibited:
- Filing payment disputes or chargebacks in bad faith or without valid grounds;
- Attempting to obtain Digital Assets without valid payment; and
- Any other fraudulent or abusive use of payment methods.
If a user has an issue with a purchase, the Service Provider strongly encourages the user to contact the Support Center first so that the Service Provider may attempt to resolve it directly before filing a chargeback.
[3-3-6] Classification of Cases and Measures
Cases may be classified as follows:
- Unauthorized Payment: a payment made without the authorization of the holder of the payment method (e.g., stolen card or unauthorized use of payment credentials, or use of another person’s payment method without their permission);
- Friendly Fraud: a chargeback filed by a user who made a legitimate purchase but later disputes the transaction without valid grounds; and
- Intentional Abuse: deliberate or repeated exploitation of the payment or chargeback process to obtain Digital Assets without valid payment.
Where a chargeback falls under any one of the above cases, the following measures apply to the account through which the purchase was made; where more than one row applies, the more severe measure applies:
| Applies when | Measures |
| Any chargeback under any one of the above cases | Service Restriction until the relevant Digital Assets are recovered or, where recovery is not possible, the disputed amount is settled (e.g., by repurchase). The restriction is lifted once recovery or settlement is complete. |
| Repeated or intentional abuse | Permanent Service Restriction |
| Multi-account or organized abuse | Permanent Service Restriction, with the right to pursue legal action reserved |
※ A chargeback relating to a case listed in [5-3] does not, by itself, constitute Friendly Fraud or Intentional Abuse.
[3-3-7] Additional Provisions
If a chargeback is filed after a Digital Asset has been delivered, the Service Provider may revoke, invalidate or recover any Digital Assets obtained through the relevant payment, or recover equivalent value where direct recovery is not possible, including by deducting balances, in each case to the extent permitted under relevant laws and regulations and to the extent possible from a technical perspective, whether on-chain or off-chain. Without prejudice to the measures set out in [3-3-6], where the chargeback is found to be unfounded or abusive, the following actions may be taken:
- Restrict or suspend account access; and
- Restrict transactions and use of the Service.
Where Digital Assets have been transferred to a third party or to another account, necessary measures may be taken against both the originating account and the recipient account while the investigation is in progress. To help the Service Provider resolve the issue, a user may be required to provide information or documentation related to the disputed transaction.
5. Withdrawal and Refund Policy
[5-1] All Digital Assets supplied by the Service Provider through the in-service store or other channels operated by the Service Provider are supplied in full on delivery to the user’s account or Wallet. Before completing a purchase, the user will be asked to expressly consent to the immediate performance of the contract and to acknowledge that the right of withdrawal or cancellation is lost once supply has begun. Digital Assets are non-refundable, except as set out in [5-2] and [5-3] or as required by applicable law.
[5-2] The Service Provider may provide a refund where the Digital Asset was not delivered, is materially defective or unusable due to a technical issue attributable to the Service Provider, or the transaction was processed in error. No refund will otherwise be provided, including where the Digital Asset has been used, consumed, modified, converted or transferred, except as required by applicable law and subject to [5-3]. Any refund is made on the facts of the individual case and does not create any entitlement in respect of any other transaction.
[5-3] Notwithstanding [5-1] and [5-2], the following applies to Paid Content as defined in the Terms of Service. The Service Provider will provide a refund or other appropriate remedy in the following cases:
- The Paid Content was not delivered;
- The user was charged twice or charged in error;
- The Paid Content received does not match what was purchased or how it was described;
- The purchase is confirmed to have been made without the authorization of the holder of the payment method; or
- A refund is required by applicable law.
[5-4] Refund requests should be submitted to the Support Center from the account used for the purchase. The Service Provider may request information or supporting documents reasonably necessary to verify the relevant facts, and may decline or suspend the processing of a request until such information is provided. Approved refunds are issued to the original payment method without undue delay, and the Service Provider may remove the relevant Paid Content from the user’s account.
[5-5] If a user files a chargeback or payment dispute, the Service Provider will put its own refund process on hold for that purchase and follow the payment provider’s process instead. Abusive or fraudulent refund requests or chargebacks may lead to measures under Sections [3-3-5] to [3-3-7]. Where a chargeback or payment dispute is resolved in the user's favor, the Service Provider may remove the relevant Paid Content from the user's account.
[Updated] Terms of Service and End User License Agreement
The following key sections will be added or amended with this update to the Terms of Service and End User License Agreement.
[Introduction] A notice has been added that Article XIII contains a binding dispute resolution clause, a jury trial waiver and a class action waiver that may affect your rights for resolving any dispute with us.
[Article II. 3. MSN Game] The description of MSN Game has been updated. MSN Game is an online game made available on PC or mobile through the MSU Community, and certain features of MSN Game are connected to a blockchain network and allow users, at their option, to obtain, use and/or transfer certain Digital Assets for use in the game. The Item Enhancements provision has also been clarified to state that enhancements may change the characteristics or use potential of your Digital Assets.
[Article VII. Game Items, NXPC, NESO, NFT, and FT] Digital Assets may be confiscated or restricted to the extent technically possible under the Protocol where a User is found to be using the MSU Community in an inappropriate manner. The no-refund provision now applies except as provided in Article X (Fees, Payment, and Paid Content).
[Article X. Fees, Payment, and Paid Content] This Article has been restructured and expanded as follows.
A. Fees: All fees are non-refundable, except as expressly set out in Section X.C (Paid Content) or as otherwise required under applicable laws and regulations.
B. Payment: Payments may be charged by the Company, a third-party payment service provider or a merchant of record designated by the Company (a “Designated Seller”). Where Paid Content is sold through a Designated Seller, the Designated Seller is the seller of record for that purchase, charges your payment method and collects any applicable taxes at checkout, and its terms also apply to that purchase.
C. Paid Content: “Paid Content” means digital items, digital content, balances or other entitlements sold to you for a price payable in fiat currency through the Company’s web shop or any other storefront operated within the MSU Community by the Company. Digital Assets acquired using NXPC, NESO or any other Digital Asset, Digital Assets distributed free of charge, and transactions between Users on the MSU Marketplace are not Paid Content. Paid Content is bound to your account, cannot be transferred to another account or User, minted, traded on the MSU Marketplace, or converted into NXPC, NESO or any NFT or FT, and has no real-world monetary value. Provisions on (a) immediate performance and the right of withdrawal, (b) refunds and other remedies, (c) the order of consumption of paid and free items, (d) misuse of refunds, and (e) payment disputes and chargebacks have been added.
D. Taxes: Taxes may be included in the displayed price or calculated and collected at checkout by us or the Designated Seller.
[Article XI. Disclaimer of Warranties; Limitation of Liability] It has been clarified that any measure restricting transactions or payments is taken through technical functions of the Protocol and does not constitute possession, custody or control of your Digital Assets held in your Wallet by the Company.
[Article XIII. Governing Law and Dispute Resolution] By agreeing to the Terms, you waive your right to a trial by jury and your right to participate in a class action, collective action, mass action or other representative action against the Company, to the maximum extent permitted by applicable law. Proceedings arising out of or in connection with the Terms or the MSU Community may be brought only in the courts of ADGM or through any amicable dispute resolution mechanism established under ADGM rules. The Company may seek injunctive or other equitable relief in any court of competent jurisdiction to protect the intellectual property rights of the Company, its affiliates or their licensors.
